The practicalities seem quite easy to handle - a couple of option boxes in the character profile:
Will you accept challenges? Y/N
Whenever your challenges are refused, will you go on to ambush your targets instead? Y / N
Ticking Y to the second one could leave your character open to a whole range of legal sanctions (bounties, imprisonment etc).
This would allow duels / ambushes to be resolveable immediately, as now, whether the challenged party was online or not....
