Weapons Question

I recently had a duel with another player who is level 34 with 48 dueling he is able to use a level 40 weapon/firearm. Im level 34 with 38 dueling why cant I use my level 38 weapon/firearm?:eek:hmyg:

The other player was probably a soldier with the class premium.
